fa موانع فرهنگی دسترسی زنان به عدالت خانوادگی تخصصي Special پژوهشي Research دسترسی به عدالت مفهومی است که دلالت بر بعد عملی و اجرایی دستیابی فرد به نهادهای قضایی و حل مشکل حقوقی خود دارد. در عین حال که دسترسی به عدالت برای همه اقشار جامعه به صورت برابر مدنظر است اما در این میان اغلب اقشار زنان در دسترسی به نهادهای قضایی به ویژه در دعاوی خانوادگی با مسایل و مشکلاتی روبرو بوده اند.تاکید این مقاله بر تاثیر موانع فرهنگی روی دسترسی زنان به عدالت خانوادگی درون بافتار کنونی جامعه است. با توجه به رشد سالیانه زنانی که به محاکم خانواده مراجعه می کنند،بررسی موضوع از منظر زنان مراجعه کننده می تواند از اهمیت مضاعفی برخوردار باشد.بر این  مبنا روش کیفی با تکنیک مصاحبه عمیق اتخاذ شده است. یافته های تحقیق برآیند مصاحبه عمیق با 50 زن مراجعه کننده به دادگاه خانواده بوده است. نتایج این تحقیق نشان می دهد از منظر پاسخگویان موانع فرهنگی چون:ارزش های فرهنگی، عدم خودباوری و اعتماد به نفس، باورهای دینی، تحصیلات و آگاهی تخصصی به موضوع، مردسالاری، زبان، ساختار و کلیشه های جنسیتی در دسترسی ایشان به عدالت خانوادگی موثر هستند. همچنین مطابق با تئوری نقطه تلاقی از تلاقی موانع فرهنگی با عوامل زمینه ای پاسخگویان می تواند تجربیاتی متفاوت درون بافتار همسان شکل بگیرد.        Access to justice is a concept that implies the practical and operational dimension of accessing individuals in judicial institutions and solving their legal problems.Equality of access to justice for all segments of society is really important, but most women have faced difficulties in accessing judicial institutions, especially in family matters.The emphasis of this paper is on the impact of cultural barriers on women's access to family justice within the current context of society. With regard to the annual growth of women who go to family courts, consideration of the issue from the perspective of women can be more important.Based on this, a qualitative method is adopted with deep interview technique. The findings of the study are the result of in-depth interviews with 50 women having experience of family court.
